General Terms and Conditions of Sale – Les Hauts de Locmiquel
1. Purpose
These general terms and conditions of sale define the rights and obligations of the parties in the context of the remote booking of services offered by the establishment Les Hauts de Locmiquel , whose contact details are included in the booking confirmation document.
They govern all the steps necessary for booking and monitoring the stay between the contracting parties.
The customer acknowledges having read and accepted these general terms and conditions of sale as well as the specific conditions of the reserved rate, accessible on the booking platform.
These general terms and conditions of sale apply to all bookings made directly or through third-party booking platforms (OTAs).
2. Reservation
The customer chooses the services presented on the booking platform.
He acknowledges having read and understood the nature, purpose and booking procedures of the services offered and having obtained all the necessary information to make his booking with full knowledge of the facts.
The client is solely responsible for their choice of services and their suitability to their needs.
The reservation is deemed accepted by the customer at the end of the booking process.
3. Booking process and contract formation
Reservations have been made:
- either directly via the establishment's booking platform, automatically on the website, or by direct email to the operator
- either through third-party booking platforms (OTAs),
The reservation becomes firm and final subject to payment of the required deposit and express acceptance of these general terms and conditions of sale.
For bookings made directly, a rental contract or a written summary (confirmation email) specifying in particular the dates of the stay, the price, the payment conditions and the main terms of the stay is sent to the customer.
For bookings made via a third-party platform, the applicable contractual conditions are those contained in the booking confirmed on said platform, supplemented by these General Terms and Conditions.
At the end of the booking process, an acknowledgement of receipt is sent to the customer by email. It summarizes the services booked, the prices, the dates of the stay, the applicable terms and conditions of sale, as well as the contact details of the establishment.
4. Reception, assistance and services offered
The establishment offers a personalized welcome and assistance to guests upon arrival and throughout their stay, including:
- the transmission of practical information prior to arrival,
- the provision of information necessary for the installation and use of the accommodation,
- assistance if needed during the stay.
These services are organised and coordinated by the operator, either directly or through mandated service providers, according to the arrangements adapted to the stay.
5. Cancellation or modification due to the customer
In accordance with Article L.221-28 12° of the Consumer Code, the customer does not have the right of withdrawal.
Cancellation and modification conditions are specified in the specific terms and conditions of the reserved rate.
When the sums paid constitute a deposit, they are not refundable in case of cancellation, unless otherwise stipulated in the reserved rate.
All reservations are nominative and cannot be transferred to a third party.
6. Customer Obligations – Conduct – Security Deposit and Damages
The client agrees to behave respectfully towards the premises, equipment and neighborhood, and to use the accommodation in accordance with its intended purpose.
An entry and exit inventory will be carried out by the operator or by an authorized service provider.
All equipment, furniture, terraces, veranda, swimming pool and outdoor facilities are an integral part of the rental.
The client agrees to return the accommodation in a normal, used condition. As such, they are asked to:
- strip the beds at the end of your stay.
- deposit waste in the containers provided for this purpose.
- leave the equipment used (especially the barbecue) in a condition suitable for normal use.
These obligations do not in any way replace the end-of-stay cleaning, which is carried out by the operator or its service providers.
A security deposit of €3,000 is required, either by pre-authorization of a bank card via a secure provider, or by check given upon arrival.
The deposit is not cashed and is returned within a maximum of 14 days after departure, subject to the check-out inventory.
Any damage will be billed according to the actual cost of repair or replacement.
7. Responsibility
The descriptions and photographs presented on the establishment's communication materials are intended to give a true representation of the accommodation and services offered.
Minor variations may occur, however, without affecting the nature or quality of the services.
The establishment cannot be held responsible for the non-performance or improper performance of the contract in the event of force majeure, due to the client or a third party.
8. Complaints
Any complaint relating to the execution of the stay must be addressed in writing to the establishment within eight days of the departure date.
9. Prices, taxes and cleaning services
Prices are shown in euros, inclusive of all taxes (TTC), excluding tourist tax.
The tourist tax, calculated per adult per night, is payable in addition, according to the terms specified during booking or indicated on the platform concerned.
The price of the stay indicated on the website includes the provision of household linen (bed linen and towels, bath mats, tea towels) and cleaning before and after the stay, carried out by professional service providers mandated by the operator.
For bookings made via third-party platforms (OTAs), linen and cleaning are provided in the same way, but they may be subject to separate billing, in accordance with the conditions displayed on the platform concerned.
For all stays, cleaning services during the stay (intermediate cleanings) can be arranged, upon request of the client, for the duration of the stay.
These services are subject to additional charges. They are performed by the operator or by an authorized professional service provider.
The intervention days are agreed in advance with the client, depending on the organization of their stay and the operational constraints of the service provider.
Also, upon request of the client, the renewal of bed linen and towels is possible during the stay.
10. Payment
The customer provides their bank details as a guarantee of the reservation, unless otherwise specified, by credit card (Visa, Mastercard, American Express, etc.), via a secure entry.
A deposit of 20% of the total cost of the stay is required at the time of booking.
The reservation is only considered definitively confirmed after actual receipt of this deposit.
The balance of the stay must be paid by bank transfer no later than 30 days before arrival.
11. Respect for privacy
The personal data collected is necessary for the management of reservations and is intended for the establishment, the Elloha booking platform, as well as their service providers, including online payment providers.
The customer consents to the processing of their data in accordance with applicable regulations.
12. Convention on Evidence
Entering bank details, accepting these terms and conditions of sale and validating the reservation constitute an electronic signature having the same value as a handwritten signature.
The computerized records kept by the booking platform are proof of communications, orders and payments made between the parties.
13. Applicable Law and Dispute Resolution
These general terms and conditions of sale are governed by French law.
Any dispute will be submitted to the competent courts in accordance with the rules of common law.
